Aziz v MCI 208 FC 68 no credible basis

Jurisprudence Brief: 
In Aziz v. Canada (Minister of Citizenship & Immigration), [2008] F.C.J. No. 78, 2008 FC 68, the Court set aside a finding of no credible basis. In the case the applicant had provided a witness whose evidence if believed supported the claim. The tribunal failed to comment on this evidence which was not affected by the finding of lack of credibility regarding the applicant. The Court set aside the decision, holding that the tribunal erred in failing to consider the evidence of the witness.
